4. Platform Services
4.1 Marketplace Only
Mumokshu is a marketplace platform that connects Students with Teachers. We do not provide yoga instruction, fitness training, wellness services, health advice, or any form of professional training. We are not a yoga studio, fitness centre, health provider, or educational institution. This applies to all disciplines available on the Platform, including but not limited to yoga, pilates, group fitness, kickboxing, dance, meditation, and breathwork.
4.2 No Employment Relationship
Teachers listed on the Platform are independent third parties, not employees, agents, or representatives of Mumokshu. We do not control, direct, or supervise Teachers' methods of instruction, schedules, or business practices.
4.3 Mobile Applications
Our Services include mobile applications available on iOS (Apple App Store) and Android (Google Play Store). Use of the mobile applications is subject to these Terms as well as the applicable app store terms. We are not responsible for third-party app store policies, and your use of native device features (biometrics, push notifications, camera) is governed by your device manufacturer's privacy settings.
4.4 Service Availability
We strive to maintain Platform availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time, with reasonable notice where practicable. The Platform operates across multiple regions (including Australia, United States, India, United Kingdom, and Canada) and availability may vary by jurisdiction.
5. Teacher Obligations
5.1 Accurate Listings
Teachers must ensure that all class listings, profiles, qualifications, pricing, schedules, and descriptions are accurate, complete, and not misleading. Any certifications or qualifications listed must be currently valid.
5.2 Qualified Instruction
Teachers represent and warrant that they possess appropriate qualifications, training, and experience to provide the services they list. Teachers are solely responsible for the quality, safety, and legality of the instruction and services they deliver.
5.3 Insurance
We strongly recommend that all Teachers maintain appropriate professional indemnity and/or public liability insurance covering their teaching activities. For Teachers operating in Australia, professional insurance is strongly advised and may be required by certain venue operators.
5.4 Independent Contractor Status
Teachers acknowledge and agree that they are independent contractors and not employees, workers, agents, or partners of Mumokshu. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between Teachers andMumokshu. Teachers are solely responsible for:
- Setting their own schedules, prices, and cancellation policies
- Providing their own equipment and teaching materials
- Managing their own client relationships outside the Platform
- Compliance with all applicable laws and regulations in their jurisdiction
5.5 Tax Obligations
Teachers are solely responsible for determining and fulfilling their own tax obligations, including but not limited to income tax, goods and services tax (GST), value added tax (VAT), sales tax, and any other applicable taxes in their jurisdiction. Mumokshu does not withhold taxes on behalf of Teachers and will issue tax-related documents (such as 1099 forms for US-based Teachers) where required by law. We recommend consulting with a qualified tax professional.
5.6 Compliance with Laws
Teachers must comply with all applicable local, state, national, and international laws and regulations, including consumer protection laws, data protection laws, and any licensing or permit requirements for their teaching activities.
6. Student Obligations
6.1 Accurate Information
Students must provide accurate personal and contact information and keep it up to date. Students are responsible for communicating any relevant health conditions, injuries, or limitations to their Teacher before participating in any class.
6.2 Respectful Behaviour
Students agree to treat Teachers and other Users with respect and courtesy. Harassment, abuse, discrimination, or disruptive behaviour of any kind is prohibited and may result in immediate account termination.
6.3 Health Disclaimer & Assumption of Risk
Participation in yoga, pilates, fitness, and wellness activities involves inherent physical risks. By booking and attending classes through the Platform, Students acknowledge that:
- They are participating voluntarily and at their own risk
- They should consult a qualified medical professional before beginning any new exercise or wellness program, particularly if they have pre-existing health conditions, injuries, or are pregnant
- Mumokshu is not responsible for any injury, illness, or adverse health outcome resulting from participation in classes booked through the Platform
- They are responsible for determining whether a particular class or activity is appropriate for their fitness level and health status
7. Booking & Payments
7.1 How Booking Works
Students may browse class listings and book sessions directly through the Platform. A Booking is confirmed once payment has been successfully processed. You will receive a confirmation email with Booking details.
7.2 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. Mumokshu does not store your full credit card details on our servers.
7.3 Platform Commission
Mumokshu charges a platform commission on each transaction. The standard commission rate is 5% of the transaction amount for Teachers on the Free plan. Teachers on paid subscription plans (Pro and Business) may be eligible for reduced commission rates as detailed in their plan terms. The commission is automatically deducted before funds are transferred to the Teacher.
7.4 Teacher Payouts
Teacher earnings (less platform commission and applicable payment processing fees) are transferred to the Teacher's connected Stripe account. Payout timing depends on the Teacher's Stripe account settings and country, but typically occurs within 2–7 business days after the class is completed. Mumokshu uses Stripe Connect to facilitate direct payouts to Teachers.
7.5 Currency Handling
Teachers set their prices in their preferred currency. Students may be charged in the Teacher's listed currency or their local currency, depending on payment method and location. Any currency conversion is handled by Stripe or the Student's payment provider, and exchange rate fees may apply. Mumokshu is not responsible for exchange rate fluctuations or conversion fees.
7.6 Pricing
Teachers set their own prices for classes, recordings, memberships, and pass packs. All prices displayed on the Platform are set by the Teacher and may or may not include applicable taxes, depending on the Teacher's jurisdiction and settings. Students are responsible for any additional taxes, duties, or fees that may apply.
8. Cancellation & Refunds
8.1 Teacher-Set Cancellation Policies
Each Teacher sets their own cancellation and refund policy, which is displayed on their class listing. By making a Booking, you agree to the Teacher's stated cancellation policy. Common policies include:
- Flexible: Full refund if cancelled 24+ hours before class
- Moderate: Full refund if cancelled 48+ hours before class
- Strict: Full refund if cancelled 7+ days before class; 50% refund within 7 days
8.2 Platform Refund Processing
Refunds are processed through the Platform in accordance with the Teacher's stated cancellation policy. If a Teacher cancels a class, Students will receive a full refund. Refunds are returned to the original payment method and may take 5–10 business days to appear on your statement.
8.3 Non-Refundable Items
The following are generally non-refundable:
- Platform service fees and payment processing fees
- Completed classes (after attendance or after the class end time)
- On-demand recordings once accessed or downloaded
- Subscription fees for the current billing period after the cancellation window
8.4 Dispute Resolution for Refunds
If you believe you are entitled to a refund that has not been processed in accordance with the applicable cancellation policy, please contact us at support@mumokshu.com within 30 days of the Booking date. We will review the request and facilitate resolution between the Student and Teacher.
9. Subscriptions
9.1 Subscription Plans
Mumokshu offers subscription plans for Teachers and Studios, including Free, Pro, and Business tiers. Each plan provides different features, commission rates, and support levels as detailed on our Pricing page.
9.2 Auto-Renewal
Paid subscription plans (Pro and Business) automatically renew at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date. You will be charged at the then-current rate for your plan.
9.3 Cancellation of Subscriptions
You may cancel your subscription at any time through your account settings. Upon cancellation:
- You will retain access to your paid features until the end of the current billing period
- Your account will revert to the Free plan at the end of the billing period
- No prorated refunds are provided for partial billing periods
- Any reduced commission rates associated with your plan will revert to the standard rate
9.4 Price Changes
We may adjust subscription pricing with at least 30 days' prior notice. Price changes will take effect at the start of your next billing cycle. If you do not agree with a price change, you may cancel your subscription before it renews.
10. Retreats
10.1 Special Terms for Retreats
Retreats are multi-day or multi-session experiences that may involve accommodation, travel, meals, and other services in addition to wellness instruction. Due to the nature of retreats, special terms apply.
10.2 Deposits & Installments
Teachers may require a non-refundable deposit to secure a retreat booking. Where offered, Students may pay the balance in installments according to the payment schedule set by the Teacher. Failure to make installment payments on time may result in forfeiture of the deposit and cancellation of the booking.
10.3 Retreat Cancellation
Retreat cancellation policies are set by the Teacher and are typically more restrictive than standard class policies due to the logistical commitments involved. Common deadlines include:
- 60+ days before: Full refund less deposit
- 30–59 days before: 50% refund less deposit
- Less than 30 days: No refund
Students are strongly encouraged to purchase travel insurance that covers cancellation, medical expenses, and interruption for retreat bookings.
10.4 Force Majeure
If a retreat is cancelled due to circumstances beyond the reasonable control of the Teacher or Platform — including but not limited to natural disasters, pandemics, government restrictions, war, terrorism, or severe weather (“Force Majeure Event”) — the Teacher will use reasonable efforts to offer alternative dates or a credit. Refund terms during Force Majeure Events will be determined on a case-by-case basis, taking into account non-recoverable costs incurred by the Teacher.
11. Content & Intellectual Property
11.1 Teacher Content Ownership
Teachers retain full ownership of all Content they create and upload to the Platform, including class descriptions, photographs, videos, recordings, course materials, and branded elements.
11.2 Platform Licence
By uploading Content to the Platform, Teachers grant Mumokshu a non-exclusive, worldwide, royalty-free licence to display, distribute, reproduce, and promote that Content solely in connection with operating and marketing the Platform. This licence terminates when the Teacher removes the Content or closes their account, except for Content that has been shared or purchased by Students prior to removal.
11.3 Student Use of Content
Students may access Content (including on-demand recordings) solely for personal, non-commercial use. Students must not:
- Copy, reproduce, distribute, or publicly display any Content
- Record, screenshot, or capture live classes or on-demand sessions
- Share access credentials to allow others to view purchased Content
- Use Content for commercial purposes, including teaching or resale
11.4 Platform Intellectual Property
